I have come to the conclusion that majority of the internet doesnt know what the hell they are doing. Why make a rule thats almost impossible to enforce... i can see it for a disclaimer for pornagraphy sites ya, kiddies shouldnt see that stuff and the site shouldnt be accountable for there actiond... but for a forum board... while there can be some mature stuff going on... you cant give us an inforcable rule. Then again... imo. Ill just chill over here and try not to think too hard.

@Sakura I understand that through and through. But i think they look at it way too narrow. I swear the states are just... ugh. Im not getting political... to early for that. I just gonna leave it at my thoughts of the stupidity surronding it and go back to my corner.

This isn't about the states. It is international law.

 

And it isn't about the content being mature, it is a matter of protecting the privacy of children.

 

And Sakura, you say that you know of one active user who is under the legal age... why aren't they banned, again?

I can ask Night or evilfusion if they have access to something of that sort, but it would help to clear up confusion (although again, members can still lie about it + click box).

That, and the rules should have that point clearly stated. 

 

I think Aix put it in somewhere, but should check. Otherwise, it'll have to be written in.

The older rule set probably had that, but they're buried some pages away.

Is it possible for a Super Moderator to add a "13 or older" check box to the member registration wibblywob? It would help clear up any possible confusion. It is probably somewhere in the terms and conditions, but nobody reads those, and this rule should definitely be known by new users.

and you think that if a person under 13 is willing to not provide/ lie about their age they wouldn't just check that check box? if the answer is yes, i applaud your utter stupidity. we could force members to give their birthdays, but lying is a thing.  I mean I get that we can't really enforce it and we shouldn't have an open show of nonchalance, but as Torm said:

So I really don't think that we need to do anything except what we are: banning the account until the person is 13 if/when an account comes up that the person in some way shows that they are not 13.

While that's true, it's very easy for YCMaker to be taken to court if, say, an underage kid's parent is looking over their shoulder when the kid (accidentally) happens to open up a thread that got hit by a porn raid. Or had cards with loli pics in them. The rationale here is that YCMaker didn't provide proper indication of there being "mature" content on this forum.

 

These scenarios are horseshit as we all know it to be. (Though admittedly the latter's had a distinct possibility of happening more than once.) That said, it illustrates the need for such measures to be taken.

I mean is there any way to enforce this law beyond what we're doing? If there isn't a thing in the T&C about being a 13 and over site, just stick it in there and *poof* all legal sheet goes out the door. It ain't our fault if someone doesn't read the T&C.

That's exactly the suggestion and I'm not sure why it hasn't been implemented. (or if it has it should be pointed out here)

Just smack a "check this box if you're 13+" or something of that sort, and it'd be good. The site won't get into deep sheet if someone decides to capitalize on this issue.

thing about a check box is that it might not get us out of legal trouble if something happens. i think if it's not in the T&C that this site is 13+, it needs to be added before something happens.

this is like the only answer. after that just keep doing what we're doing: banning accounts that show that the person isn't 13+. can we lock the topic now since i basically just cut the bs? i mean come on. no one in 3 pages thought "Hmm. Maybe if this is such a big thing it should be in the T&C.". that's utterly pathetic.

No we can't lock this topic because we need people to SEE this so that the change can be done so that YCM doesn't possibly get into legal issues.

A check box is basically terms and conditions. Cause the terms and conditions usually have a check box saying you read the terms and conditions.

 

And neither terms and conditions or a check box are "effective" since all those things can be ignored, but either one of them will prevent legal action from being taken against the site, because it shows they are at least trying to get across that certain age groups aren't supposed to be here.

 

And honestly, getting to the point and being an ass about it is often not very effective. Especially since one does not always get to the point in the process of...uhh....assery. But that's a different matter entirely.

eh. T&C would be better imo. a check box separate from the T&C might not get us out of legal stuff, while stuff in the T&C definitely will; even if it's ignored.

sorry that saying 'check box' sounds like it's gonna be separate from T&C, but that's what it sounds like to me.

Just as a sidenote guys, the rules have been updated with a reminder that you need to be 13+ to register for YCM.

(Otherwise, a notice in News mentioning this might help)

 

As for things related to enforcement, right now, we'll just suspend members on-sight who we have definitive proof of being under the age of 13 (either you mention it somewhere on the forum, or profile explicitly says that).

 

Thus far, both of the known members have been dealt with; there are likely more that are currently inactive, or only using the cardmaker.

 

Also keep in mind that some of you would have been subjected to the same thing (temporary account suspension) during the time you registered, if this had been strictly enforced.

Terms & Conditions link appears to not be working though, so mentioning it clear-on in there isn't a viable option at this time.

I've brought the checkbox issue up with Night/evilfusion to see if it can be done; likely is, but I do not know.
