Cuomo signed a bill into law allowing Democrats to see his returns, and the House Committee is currently suing the Treasury after it ignored the subpoenas. Refusing to agree with a duly issued subpoena grants Democrats a legitimate case in that lawsuit. If this does go the same way as the tax subpoenas, it means more lawsuits are coming Trump's way.

 

In this case, the subpoenas are themselves part of a lawsuit, and the DOJ is specifically asking the appeals court to block them, so chances are that the administration's strategy of just refusing to show up in court will not work.

A poor ruling on their part, and the reasoning behind their argument fails to address the issue. They believe the suit was about the DOJ giving additional consideration or "bonus points" to other applicants, when the administration is specifically excluding sanctuary cities.

Well they are, Trump isn't gonna pocket the money, he's taking, for example, what SanFran would get, and giving it to say Miami

I understand that, and that is why this appeal was wrong. Sanctuary cities are entitled to that money, and should not be deprived of that just because Trump is being petty.

So the excuse the DOJ is hiding behind does not appear to have any legitimate basis. This is just inventing a technicality for the express purpose of claiming that sanctuary cities failed to meet it.
